SCO, eski Caldera, Linux'cularin kendi "fikri mulkiyet" haklarina aykiri
davranip davranmadiklarini tespit icin, avukat David Boies'i tuttu. Boies,
Microsoft'a karsi acilan tekelcilik davasinin "canavar" avukati.

Sizce, Gnu/Linux'a karsi SCO'nun bir fikri mulkiyet hakki olabilir mi?

"The most substantial intellectual property in Unix comes from SCO," Chris
Sontag, senior vice president for SCOsource, said in a statement. "While
Linux is an open-source product, it shares philosophy, architecture, and
APIs with Unix. SCO will help customers legitimately combine Linux and Unix
technology to run thousands of Unix applications."

As open-source software, volunteers have developed Linux over the years.
Most Linux users have assumed the operating system, built by a team of
developers headed by Linus Torvalds, did not involve proprietary technology
from Bell Labs.

As SCO announced, "SCO has no desire to take legal action against fellow
Linux vendors." Since all the major players, with the exception of Red Hat,
are already closely partnered with SCO in the UnitedLinux initiative SCO is
highly unlikely to attack its partners.

In a broader vein, SCO is exploring the options of getting intellectual
property payments from companies that use SCO licensed libraries from
operating system vendors that sell the libraries without paying for them.
There's nothing new here. Companies like IBM have been, and are continuing
to pay, SCO for the use of these and other licenses.

What we have here is SCO exploring whether there's any money to be made
from operating system companies that are using its Unix intellectual
property licenses without permission. The net effect on existing Linux
customers should be zero. At most, a few operating system companies using
the libraries without permission might eventually have to pay SCO
back-dated licensing fees.

Finally, for some reason, there are rumours floating about that SCO is
somehow trying to use the UNIX trademark to get money from Linux vendors
and users. This is complete nonsense. SCO owns a lot of Unix's intellectual
property. The Open Group owns the Registered Trademark UNIX and has for
years. People claiming that SCO is somehow planning to use the Unix
trademark to gain control of Linux or make money simply have no idea what
they're talking about.
